Terms and Conditions

The following Terms and Conditions govern all products manufactured by Superb Cakes, LLC, a home-based business specializing in the creation of unique, custom-made cakes. It is the responsibility of the client to thoroughly review these Terms and Conditions prior to placing an order with our company. By initiating contact with the client, we will assume that the client has read and acknowledged an understanding of these Terms and Conditions.

Clients Code of conduct

At Superb Cakes, LLC, we conduct our business with the highest ethical standards and in strict compliance with all applicable laws and public regulations. Consequently, it is essential to maintain professionalism at all times during interactions between clients and suppliers throughout the process and execution of all orders. Superb Cakes, LLC adheres to a zero-tolerance policy for any clients who do not demonstrate the highest level of professionalism during phone calls and in-person interactions with our staff. Once an order is confirmed, clients are prohibited from making last-minute changes to any product while it is in production. If a product has yet to be made, amendments may be permitted if mutually agreed upon by both the client and the supplier; however, a fee may apply for such changes. Please note that modifications to cake toppers or figurines are not allowed once the order has been placed, as we cannot return these items to the supplier utilized by Superb Cakes, LLC. We reserve the right to decline any orders that do not align with the company’s standards and integrity. This includes cake designs that promote hate, racism, inappropriate content, or that violate any federal civil rights. Furthermore, Superb Cakes, LLC retains the right to cancel any order should a client engage in disorderly behavior or exhibit rudeness, including the use of profanity, slurs, or insults during the order process. In such instances, the client may forfeit their deposit (if applicable), and/or 50% of the total amount paid will be reimbursed within three business days.

Ingredients 

Superb Cakes LLC employs a variety of cake mix brands, pre-made fillings, and ready-to-use whipped cream, which may contain or come into contact with allergens such as soy, wheat, dairy, nuts, or other substances. It is the responsibility of the customer to communicate any allergy-related concerns prior to requesting a quote or purchasing any products. 

Allergens Disclosure 

The customer must inform their guests of all relevant allergen information. Superb Cakes LLC (hereafter referred to as "the Supplier") shall not assume liability for any allergic reactions experienced by clients or their guests as a result of consuming the cake or other products. This disclaimer also encompasses various health risks, including those associated with individuals who are diabetic and may be advised against consuming such products, which could pose significant health hazards. 

Product Care and Health Considerations

All products produced by Superb Cakes, LLC are intended for consumption on the day of the associated event. The Supplier will provide detailed instructions to the client regarding the appropriate care and handling of its products. Superb Cakes, LLC shall not assume liability for any negligence, misuse, improper storage, or mishandling of products that may render them unsafe for consumption, potentially resulting in foodborne illnesses or poisoning for the client or their guests. While the products may remain safe for consumption for a limited period, all items crafted by Superb Cakes, LLC are subject to expiration following the event date. By engaging with Superb Cakes, LLC, the client acknowledges and agrees to these terms and conditions.

Gluten-Free Product

We procure pre-formulated gluten-free cake mixes from an organic chain supermarket. To prevent cross-contamination with wheat, we implement several critical measures. All baking equipment is meticulously washed, rinsed, and sanitized to address allergen concerns. By reviewing and purchasing our products, the customer acknowledges and accepts the waiver of liability associated with their use. 

Order Quotes

Clients are entitled to receive a price quotation prior to the acquisition of a product. All quoted orders shall remain valid for a duration of seven days from the date of issuance. Following the acceptance and approval of the quote, an invoice will be generated, and payment must be submitted to secure the date and service. In the event that the quote is not accepted by the specified deadline, the system will automatically cancel the quote, requiring a new request for a quotation. Due to the variability in pricing for certain products, any new quote may be subject to an increase in price. Therefore, it is imperative that clients accept the quote promptly when prepared to place their order, ensuring that this action occurs within seven days from the date of issuance.

Orders

Due to the volume of our bookings, we require a minimum notice period of seven days for all orders. However, we will make every effort to accommodate last-minute cake requests, contingent upon our availability. It is essential to acknowledge that any products ordered based on images or photographs from other cake makers will be executed according to our artistic interpretation. We do not guarantee an exact replica of the requested product as depicted in the provided image; nonetheless, we will strive to recreate a cake inspired by other artists. We believe it is unethical to appropriate ideas from fellow artists; therefore, your cake will be crafted based on our unique design perspective. 

Deposits (if agreed) 

To secure your reservation for orders placed between 10 to 20 days in advance, a non-refundable deposit of 50% of the total balance is required, contingent upon mutual agreement between the client and Superb Cakes, LLC. It is essential that all orders are paid in full prior to fulfillment, including those made at the last minute. The deposit must be submitted within seven days of receiving the quote and before the expiration date of that quote. For all orders, the remaining balance must be settled before the scheduled date of pick-up or delivery. Please note that all sales are final once the product has been completed and either delivered or picked up. 

Unforeseen Circumstances

In the event that Superb Cakes, LLC must cancel a booking due to acts of God or unforeseen circumstances that impede the fulfillment of the ordered product, we shall promptly notify the client to facilitate a full refund. Please be informed that the refund will be processed using the original payment method employed. All deposits, regardless of the payment method used, will be refunded to the customer within three business days following the notification. Refunds will be executed solely through the original payment process; we do not issue checks, money orders, or cashier's checks. 

Delivery 

We provide delivery services to designated locations within Florida's tri-county area, which includes Miami, Broward, and West Palm Beach. The delivery fee for 2025 is determined based on the IRS Florida Businesses rate, established at $0.70 per mile. Delivery will be conducted with the highest standards of safety and professionalism. Both parties shall mutually agree upon a specific date and time for the delivery. If the client is unable to receive the cake in person, it is essential that the client appoints a representative to accept the product on their behalf. Should the customer be unavailable at the agreed-upon location at the specified time, and we are unable to make contact, the product will be returned to our facility for pick-up. In such cases, the customer will be required to either collect the product or bear an additional delivery fee.

Liability 

Upon the successful delivery and transfer of ownership of the product in satisfactory condition, the responsibility for the storage and maintenance of the cake shall rest with the customer, in accordance with our specific instructions. We expressly disclaim any liability for damages incurred by the cake subsequent to the transfer of ownership. The client assumes full responsibility for the product. Superb Cakes, LLC shall not be held liable for any health risks arising from the client's negligence or improper handling and storage of the cake. The client acknowledges that this product is intended for same-day consumption. 

Publication

Superb Cakes, LLC reserves the right to utilize any or all images of products created by the company for promotional and marketing purposes. This encompasses photographs uploaded to various business review platforms or social media channels by clients. It is essential to clarify that Superb Cakes, LLC will not display images that include clients’ faces or likenesses for promotional purposes without obtaining explicit consent from the client.
