Superb Cakes, LLC.
The following Terms and Conditions govern all products and services provided by Superb Cakes, LLC, a home-based bakery specializing in custom-designed cakes. You “The client (s)” is (are) responsible for reviewing these Terms and Conditions in full prior to placing an order. By requesting a quote, placing an order, or submitting payment, the client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
Client Code of Conduct
At Superb Cakes, LLC, we conduct business in accordance with the highest ethical standards and in compliance with all applicable laws and regulations. Professional and respectful communication is required at all times. We maintain a zero-tolerance policy for abusive, disorderly, or unprofessional behavior, including but not limited to profanity, slurs, insults, harassment, or threatening conduct. Superb Cakes, LLC reserves the right to refuse or cancel any order if such behavior occurs. Once an order is confirmed and production has begun, last-minute changes are not permitted. If production has not yet started, limited changes may be approved at our discretion and may be subject to additional fees. Changes to cake toppers, figurines, or custom-ordered décor are not permitted once the order is placed, as these items are non-returnable. We reserve the right to decline any order that does not align with our company values, standards, or legal obligations. This includes, but is not limited to, designs that promote hate, racism, discrimination, inappropriate content, or violations of federal or state civil rights laws. If an order is canceled due to client misconduct, Superb Cakes, LLC may retain the deposit (if applicable). If full payment has been made, up to 50% of the total amount paid may be refunded within three (3) business days, at our discretion.
Ingredients & Allergy Notice
Superb Cakes, LLC uses a variety of cake mixes, pre-made fillings, and ready-to-use whipped cream products. These items may contain or come into contact with common allergens, including but not limited to: wheat, dairy, eggs, soy, peanuts, tree nuts, and other allergens. It is the client’s responsibility to disclose all allergy-related concerns prior to requesting a quote or placing an order.
Allergen & Health Disclaimer
The client is responsible for informing their guests of all allergen information. Superb Cakes, LLC (hereafter referred to as “the Supplier”) assumes no liability for allergic reactions or adverse health effects experienced by clients or guests. This includes, but is not limited to, risks associated with diabetes, dietary restrictions, food sensitivities, or other medical conditions. By placing an order, the client accepts full responsibility for communicating all relevant health and dietary considerations to their guests.
Product Care & Consumption
All products are intended for consumption on the day of the event. The Supplier will provide product care and handling instructions. Superb Cakes, LLC shall and will not be held liable for any illness, damage, or loss resulting from improper storage, mishandling, neglect, transportation by the client, or failure to follow care instructions. Once delivered or picked up, all responsibility for the product transfers to the client.
Gluten-Free Products
Gluten-free products are prepared using pre-formulated gluten-free mixes purchased from reputable retailers. While we take reasonable steps to reduce cross-contamination, including thorough cleaning and sanitizing of equipment, we do not operate in a certified gluten-free facility. By ordering gluten-free products, the client acknowledges and accepts the potential risk of cross-contamination and releases Superb Cakes, LLC from liability related to gluten exposure.
Quotes & Pricing
All quotes are valid for seven (7) days from the date of issuance. Upon acceptance, an invoice will be generated and payment is required to secure the date and services. If a quote expires, a new quote must be requested and pricing may be subject to change due to ingredient, supply, or market fluctuations.
Orders & Design Policy
A minimum notice period of seven (7) days is required for all orders. Last-minute requests may be accommodated based on availability but are not guaranteed.Reference images from other cake designers are used for inspiration only. Superb Cakes, LLC does not guarantee exact replicas of another artist’s work. All cakes are created using our own artistic style and interpretation.
Deposits & Payments
For orders placed 10 to 20 days in advance, a non-refundable deposit of 50% of the total order may be required, subject to mutual agreement. The remaining balance must be paid in full prior to pick-up or delivery. All orders must be paid in full before fulfillment. Once the product is completed and delivered or picked up, all sales are final.
Unforeseen Circumstances
In the event that Superb Cakes, LLC must cancel an order due to acts of God, emergencies, or other unforeseen circumstances beyond our control, the client will be notified promptly and issued a full refund via the original payment method. Refunds will be processed within three (3) business days. Refunds are issued only to the original form of payment. No checks, money orders, or alternative refund methods will be provided.
Delivery Service
Delivery is available within the Florida tri-county area, including Miami-Dade, Broward, and Palm Beach counties. Delivery fees are calculated based on mileage using the IRS Florida business mileage rate (currently $0.70 per mile for 2025). A mutually agreed-upon delivery date and time is required. If the client is unavailable to receive the order, a designated representative must be present. If no one is available and we are unable to make contact, the product will be returned for client pick-up. Additional delivery attempts will incur an additional delivery fee.
Liability & Transfer of Responsibility
Once the product is delivered or picked up in satisfactory condition, all responsibility for the product transfers to the client. Superb Cakes, LLC is not liable for damage, spoilage, or health-related issues resulting from improper storage, handling, transportation, or failure to follow care instructions.
Terms of Services
Photography & Publication Rights
Superb Cakes, LLC reserves the right to photograph all products and use images for marketing, advertising, website content, social media, and promotional purposes. Client faces or identifying likenesses will not be used without prior written consent.
Refunds & Cancellation
- All sales are final. A full refund may be issued if a cancellation request is submitted within forty-eight (48) hours of the original purchase date, provided that production has not begun. For cancellations requested after the initial 48-hour period, a non-refundable cancellation fee of twenty percent (20%) of the total order amount will apply. No refunds will be issued for products that are in production, completed, damaged, or scheduled for pick-up or delivery within seventy-two (72) hours of the scheduled fulfillment time.
- Due to food safety regulations and the perishable nature of baked goods, all unclaimed or uncollected items will be discarded and are not eligible for refunds, as all products are non-resalable.
- Approved refunds will be processed through our third-party payment processor (Square, Inc.) within seventy-two (72) hours of approval. Please allow an additional three (3) to five (5) business days for your financial institution to post the funds to your account. All refunds will be issued to the original form of payment.
