**Terms and Conditions for Superb Cakes, LLC**
The following Terms and Conditions govern all products manufactured by Superb Cakes, LLC.
**Ingredients**
All cake mixes, fillings, and icings may contain or come into contact with allergens such as soy, wheat, dairy, nuts, or other substances. The customer bears the responsibility of communicating any allergy-related concerns prior to the confirmation of the booking. Furthermore, the customer must convey all relevant allergy information to their guests. Consequently, the Supplier accepts no liability for any allergic reactions that may arise from the consumption of the cake. All products are designed for consumption on the day of the event. The Supplier shall not be held accountable for any improper storage or mishandling of products that may remain consumable but are subject to expiration after the event date.
**Important Disclaimer: Gluten-Free Product**
**Concerning Our Gluten-Free Menu Items:** We procure our specially formulated gluten-free cake mix from an organic chain supermarket. Several critical measures are implemented to prevent cross-contamination of gluten-free items with wheat. All baking equipment is meticulously washed, rinsed, and sanitized to mitigate allergen concerns. By reviewing and purchasing our products, the customer acknowledges and accepts that liability is hereby waived.
In our facility, cake mixes, whipped cream, and toppings designated for gluten-free cakes are stored in a specific area, separate from other food items to ensure safety and prevent cross-contamination. Gluten-free cakes are baked utilizing thoroughly cleaned baking pans to avoid direct contact with surfaces employed for other types of cakes. Furthermore, the preparation of gluten-free cakes occurs in isolation from any wheat products, ensuring that the gluten-free cakes are developed independently of all other cakes.
**Order Quotes**
All order quote remain valid for a period of seven days from the date of issuance. Once a quote is accepted and approved, an invoice will be generated, and payment must be made to secure the date and service.
**Orders**
Due to the frequency of our bookings, we require a minimum notice period of seven days for all orders. However, we will endeavor to accommodate last-minute cake requests, contingent on our availability. It is essential to note that any products ordered based on images or photographs provided by other cake makers will be interpreted according to our artistic vision. We do not guarantee a precise replica of the product as depicted in the provided image.
**Deposits**
A non-refundable deposit of 25% of the total balance is required to secure a reservation. However, Last-minute orders must be paid in full. The deposit must be submitted no later than seven days before the scheduled pick-up or delivery date. All sales are final once the product has been completed and delivered or picked up.
**Unforeseen Circumstances**
In the event that we must cancel the booking due to illness or any unforeseen circumstances that prevent us from fulfilling the ordered product, the deposit will be refunded to the customer within three days of notification. Refunds will be processed solely through original payment process; we do not issue checks, money orders, or cashier’s checks. Should the customer opt to receive a refund via these alternative methods, they will be responsible for any associated service fees.
**Final Balance Payments and Pickups**
The outstanding balance must be settled on or before the scheduled pickup date, prior to the product being dispatched from our premises. In the case of cash payments, we kindly request that the exact amount be provided, as we may not be able to accommodate requests for change on-site or during delivery. In the case of payment made via internet transfer, the funds must be credited to the account before the product is released from our premises. The customer is responsible for inspecting the condition of the product prior to departing from the premises. Upon removal, the customer assumes responsibility for ensuring the safe transportation of the product to its intended destination and for adhering to our storage instructions to preserve optimal taste and quality.
**Delivery**
We provide delivery services to select locations within Florida's tri-county area, which includes Miami, Broward, and West Palm Beach. The delivery fee is a fixed rate regardless of distance: Broward County $15.00; Miami and West Palm Beach $20.00. Delivery will be conducted safely and professionally. Following the successful delivery and transfer of ownership of the product in satisfactory condition, the customer is responsible for storing and maintaining the cake according to our instructions. We disclaim any liability for damages sustained by the cake after the transfer of ownership.
Both parties shall mutually agree upon a designated delivery date and time. Should the customer be unavailable at the specified location at the agreed time, and should we be unable to establish contact, the product will be returned to our facility. Under such circumstances, the customer will be obligated to retrieve the product.
**Publication**
We reserve the right to utilize any images of the products for promotional and marketing purposes.
