**Terms and Conditions for Superb Cakes, LLC**
The following Terms and Conditions govern all products manufactured by Superb Cakes, LLC. It is the client's responsibility to thoroughly review this disclaimer. Upon establishing contact with the client, we will assume that the client has read and acknowledged these terms and conditions.
**Ingredients**
Superb Cakes LLC utilizes a range of cake mix brands, pre-made fillings, and ready-to-use whipped cream icings, which may contain or come into contact with allergens such as soy, wheat, dairy, nuts, or other substances. It is the responsibility of the customer to communicate any allergy-related concerns prior to requesting a quote or purchasing any products. Additionally, customers must inform their guests of all pertinent allergy information. Accordingly, Superb Cakes LLC (hereafter referred to as "the Supplier") shall not assume liability for any allergic reactions resulting from the consumption of the cake or other products. This disclaimer also extends to other health risks, including those pertaining to diabetic individuals who may be advised against consuming such products, as they could pose health hazards.
Furthermore, it is understood that all products are intended for consumption on the day of the event. The Supplier shall not be held responsible for any misuse, improper storage, or mishandling of products that, while potentially remaining consumable, are subject to expiration following the event date. By engaging with Superb Cakes LLC, the client acknowledges and agrees to these terms and conditions.
**Important Disclaimer: Gluten-Free Product**
We procure our specially formulated gluten-free cake mix from an organic chain supermarket. Several critical measures are implemented to prevent cross-contamination of gluten-free items with wheat. All baking equipment is meticulously washed, rinsed, and sanitized to mitigate allergen concerns. By reviewing and purchasing our products, the customer acknowledges and accepts that liability is hereby waived.
In our facility, cake mixes, whipped cream, and toppings designated for gluten-free cakes are stored in a specific area, separate from other food items to ensure safety and prevent cross-contamination. Gluten-free cakes are baked utilizing thoroughly cleaned baking pans to avoid direct contact with surfaces employed for other types of cakes. Furthermore, the preparation of gluten-free cakes occurs in isolation from any wheat products, ensuring that the gluten-free cakes are developed independently of all other cakes.
**Order Quotes**
In the event that a client requests a quotation, all quoted orders shall remain valid for a period of seven days from the date of issuance. Upon acceptance and approval of the quote, an invoice will be generated, and payment must be remitted to secure the date and service. Should the quote not be accepted by the deadline, the system will automatically cancel the quote, necessitating a new request for a quotation. Given the fluctuations in pricing for certain products, any new quote may be subject to a price increase. Therefore, it is imperative that you accept the quote promptly when you are prepared to place your order, ensuring it is done within seven days from the date of issuance.
**Orders**
In light of the volume of our bookings, we necessitate a minimum notice period of seven days for all orders. Nonetheless, we will make every effort to accommodate last-minute cake requests, subject to our availability. It is important to understand that any products ordered based on images or photographs from other cake makers will be executed according to our artistic interpretation. We do not guarantee an exact replica of the product as depicted in the provided image.
**Deposits**
To secure your reservation for orders placed between 10 to 20 days in advance, a non-refundable deposit of 50% of the total balance is required, contingent upon mutual agreement between the client and Superb Cakes, LLC. It is essential that all orders are paid in full prior to fulfillment, including those made at the last minute. The deposit must be submitted within seven days of receiving the quote and before the expiration date of that quote. For all orders, the remaining balance must be settled before the scheduled date of pick-up or delivery. Please note that all sales are final once the product has been completed and either delivered or picked up.
**Unforeseen Circumstances**
In the event that Superb Cakes, LLC must cancel a booking due to unforeseen circumstances that hinder our ability to fulfill the ordered product, we will promptly communicate with the client to arrange for a full refund. Please be advised that the refund will be processed using the original payment method. All deposits, irrespective of the payment method employed, will be refunded to the customer within three business days following notification. Refunds will be executed exclusively through the original payment process; we do not issue checks, money orders, or cashier’s checks. Should the customer choose to receive a refund via these alternative methods, they will assume responsibility for any applicable service fees. Except for the circumstances outlined above, all sales of baked goods are considered final.
**Clients Code of conduct.**
Conducting business with the highest ethical standards and in compliance with all applicable laws and public regulations is fundamental to Superb Cakes, LLC. Therefore, it is imperative to uphold professionalism in all interactions between clients and suppliers throughout the order process. Superb Cakes, LLC. maintains a zero-tolerance policy for clients who fail to exhibit the utmost professionalism during the execution of their orders. Once an order is placed, clients are prohibited from making last-minute changes. Superb Cakes, LLC., along with its staff, reserves the right to reject any orders that do not align with the company’s standards and integrity; this includes any cake designs that promote hate, racism, inappropriate content, or that violate any federal civil rights. Furthermore, Superb Cakes, LLC. retains the right to cancel any order should the client behave in a disorderly manner or exhibit rudeness, including the use of profanity, slurs, or insults during the process. In such cases, the client may forfeit their deposit (if applicable), and/or a 50% of the total amount paid will be reimbursed within three business days.
**Delivery**
We provide delivery services to select locations within Florida's tri-county area, which includes Miami, Broward, and West Palm Beach. The delivery fee is a fixed rate regardless of distance: Broward County $15.00; Miami and West Palm Beach $20.00. Delivery will be conducted safely and professionally. Following the successful delivery and transfer of ownership of the product in satisfactory condition, the customer is responsible for storing and maintaining the cake according to our instructions. We disclaim any liability for damages sustained by the cake after the transfer of ownership. Both parties shall mutually agree upon a designated delivery date and time. Should the customer be unavailable at the specified location at the agreed time, and should we be unable to establish contact, the product will be returned to our facility. Under such circumstances, the customer will be obligated to retrieve the product or pay an additional delivery fee.
**Publication**
Superb Cakes, LLC. reserves the right to utilize any or all images of the products created by the company for promotional and marketing purposes. This includes photographs uploaded to various business review platforms or social media channels. It is important to note that Superb Cakes, LLC. will not employ images that contain clients' likenesses for promotional purposes unless explicit consent is obtained from the client.
**Refunds and Cancellation Policy**
All sales are deemed final. A full refund will be issued if a cancellation occurs within 48 hours of the purchase date. For cancellations made after the initial 48 hours, a non-refundable fee amounting to 20% of the total order will be applied. Please be advised that no refunds will be granted for cakes, cupcakes, or cake pops that are either in the process of production, completed, or damaged. Furthermore, refunds will not be allowed for orders scheduled for pick-up within the 48 to 72-hour timeframe. As cakes are non-resalable, any uncollected items will be disposed of.
Refunds, upon approval, will be processed within 72 hours of the agreement, employing a third-party processing system (Square, Inc.). Approved refunds may require an additional 3 to 5 business days to finalize, contingent upon adherence to all refund guidelines.
